I am the listing agent for a condo and the buyers agent sent me the complete inspection report her client paid for. They asked for only 4 items to be repaired. Seller declined so they terminated. I will be returning listing to active, the condo\'s were built in 1964 and seller wants to sell as if and not pay for any repairs. Do I just add inspection report as an attachment, market listing as being sold as is and do I need to update sellers disclosure? Any advice is welcome...

Hi Michelle! You have already figured this one out with the two very important steps you mentioned. 1) Have the seller update the seller\'s disclosure and 2) include the inspection report with it on the listing. Whenever an agent sends the full inspection report, it\'s usually because they don\'t know any better or they do it on purpose as an attempt to strengthen their position in negotiating. I wouldn\'t go so far as to say it is unprofessional, but it isn\'t very nice.

I sold a condo and closed in May 2021. There was a special assesment for 2021 - balance due at closing was $1000 but never collected. Reviewing contract and “HOA Addendum” the buyer checked paragraph #4 where it says that buyer does not require delivery of subdivision information. Title Company said they do not require resale certificate but use Datatrace (company title company uses for our tax and hoa information) was never furnished with any special assessment information due at the time of closing. Title company called HOA directly and again talked to them and ordered an updated Statement of Account. (Now this is twice) and again, no disclosure of any special assessments.\nA resale certificate was issued with a previous buyer that terminated so never went to title. This fee was due on a qtrly basis and seller had paid $1000 prior to closing but the other $1000 due was not due until after closing. Now previous owner does not want to pay so who is responsible now?\n\n

This is certainly a title policy, contractual and or omission type issue and therefore a definite question for legal to see where to start to get this resolved.

What are the risks of resale of a house that has had foundation repairs?

If there is a problem with the foundation the home will not pass inspection. This creates a problem for the buyer if they are getting a loan because a bank will not appove the loan.

We are currently renting an apartment and our lease expires July 1. When should we begin the home buying process so we can be in our house right before our lease expires?

You should start the process now. Finding the right home can take time and you don't want to be rushed. I would also recommend getting pre- approved before you start looking so you know what you can afford and shop around for a loan.

We saw a home that we liked the end of November. We walked through the house twice and did not move fast enough - we really was not financially ready and are currently leasing an apartment. The status changed to option pending continue to show about two weeks after. It then changed to pending about 2.5 weeks later... it's still listed under pending. I had my realtor check and he said it's being purchased by a investor. Why is it taking this long? I'm praying hard that the deal falls through... but I know it's probably unlikely. I received an e-mail from HAR tonight that says there was a change.. when I looked at it nothing changed it still reads pending. Why is taking so long?

There are a lot of reasons if may still show pending. I would recommend you contact the listing agent and find out what is actually going on.
